‘The Pharmacy’ Shut Down by the Texas State Board of Pharmacy

A popular dessert and drink spot located outside of downtown Dallas, named ‘The Pharmacy’ was forced to close its doors amid a name dispute with the Texas State Board of Pharmacy.

‘The Pharmacy,’ which opened last summer, recently received notification from the Texas State Board of Pharmacy that its name, “The Pharmacy” – violated the Texas Pharmacy Act which specifically states that the name ‘pharmacy’ or ‘apothecary’ cannot be used by any business expect those registered as pharmacies within the State of Texas. With little legal recourse, ‘The Pharmacy’ promptly closed its doors and plans to reopen with a new name and concept.

Business entrepreneurs should take notice that most, if not all, state boards of pharmacy have similar language which forbid any business expect registered pharmacies from using the terms pharmacy or apothecary.

This was undoubtedly a costly business mistake and one which should have been avoidable.
